1. AGREEMENT TO OUR LEGAL TERMS
We are Tashcolour Tmi, ("Company," "we," "us," or "our"), a company registered in Finland at Tikkakalliontie 231, LAHTI, Päijät-Häme 15820. Our Business ID is 3451369-9 and our VAT number is FI34513699. We operate the website tashcolour.com and provide services involving the manual intellectual analysis of user-provided data and the delivery in electronic form of a Document of Distilled Meaning (hereinafter the "Document") — a written analytical material prepared by the Provider based on information provided by the Customer (the "Services").
These Legal Terms constitute a legally binding agreement made between you ("you") and Tashcolour Tmi. By accessing the Services, you agree to be bound by these Terms. If you do not agree with all of these legal terms, then you are expressly prohibited from using the Services.
Global Availability:
• For users from the EU/EEA: If you are a consumer residing in the European Union (EU) or European Economic Area (EEA), you are protected by mandatory consumer protection laws of your country of residence, which cannot be excluded by this agreement.
• For users from the rest of the world: For all users residing outside the EU/EEA, these Terms and any relationship with the Company are governed exclusively by the laws of Finland.
Modification of Terms. We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the updated version on the Site. The "Last updated" date at the top of this document will indicate the latest revision. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
Age Requirement: By using the Services, you represent and warrant that you are at least 18 years of age or of legal age to form a binding contract in your jurisdiction.
Your use of the Services is also strictly subject to our Acceptable Use Policy, available on our Site, which is incorporated herein by reference.
2. NATURE OF SERVICES AND CONSULTING DISCLAIMER
• Human Intellectual Analysis: The Services consist of providing the Document based on the data you provide. This analysis is performed personally by the Provider (a natural person) using their own independent thinking and philosophical reasoning. No artificial intelligence (AI), automated algorithms, or machine learning tools are used in the analysis or creation of the Document.
• Language of Communication: All data, descriptions, and materials submitted by you must be provided in the Russian language. The Document will be prepared and delivered exclusively in the Russian language. The Provider does not undertake any obligation to translate submissions or the Document into any other language.
• Non-Medical and Non-Clinical: Our Services do not constitute medical, psychiatric, or clinical psychological advice. We are not a healthcare provider. The Services are not intended to diagnose, treat, or cure any mental health condition or physical disease.
• Informational Purpose Only: The Document provided is for informational purposes only. It does not constitute professional, legal, medical, or financial advice.
• User Responsibility: You are solely responsible for the accuracy of the data you provide. The Company is not responsible for any decisions or actions taken by you based on the Document provided.
• No Professional Relationship: Use of the Services does not create a professional-client relationship beyond the scope of providing a one-time document.
3. PURCHASES AND PAYMENT METHODS
All payments are processed via the Stripe payment aggregator. We accept the following payment methods:
• Credit and Debit Cards: Visa, Mastercard, American Express, and other major international systems.
• Digital Wallets: Apple Pay and Google Pay. Security: All transactions are processed through secure, encrypted channels. Our payment processing complies with the PCI DSS (Payment Card Industry Data Security Standard). You agree to provide current, complete, and accurate purchase information for all transactions.
• Pricing and Taxes: All prices displayed on the Site are inclusive of Value Added Tax (VAT/ALV) at the applicable rate in accordance with Finnish and EU legislation. The total price confirmed at the time of checkout is the final amount to be paid by the user.
4. SERVICE DELIVERY AND TIMELINE
• Manual Process: The creation of the Document is a strictly manual intellectual process. It involves deep cognitive analysis of your input by the Provider without any automation or algorithmic generation.
• Delivery Method: The Document is provided in electronic form by sending the file to the Customer at the email address provided by them.
• Timeline: We commit to delivering the final Document within a maximum of 30 calendar days from the date of successful payment confirmation.
• Commencement of Service: The performance of the Service begins immediately after the payment is confirmed, as it involves the initial processing of your input data.
• Delay: We commit to delivering the Document within a maximum of 30 calendar days. In the unlikely event that we fail to deliver the Document within this period due to technical issues or force majeure, we will notify you via email. In the event of such a delay on our part, you retain your statutory right to terminate the agreement and receive a full refund in accordance with the Finnish Consumer Protection Act.
5. NO REFUND POLICY AND WAIVER OF WITHDRAWAL RIGHT
In accordance with Article 16(a) & 16(m) of the EU Consumer Rights Directive (2011/83/EU) and the Finnish Consumer Protection Act:
• Immediate Performance: By purchasing the Services, you provide your express prior consent for the Company to begin the performance of the service immediately after the transaction is completed.
• Acknowledgment of Loss of Right: You explicitly acknowledge and agree that once the payment is processed, you lose your legal 14-day right of withdrawal and refund, as the digital service begins immediately upon payment.
• Final Sale: All sales are final. No refunds will be issued once the payment transaction is confirmed by the payment provider.
6. INTELLECTUAL PROPERTY RIGHTS
Tashcolour Tmi owns all intellectual property rights in the Site, including source code, designs, and the unique format and analytical methodology of the Document. You are granted a limited, personal, non-exclusive license to use the Document for personal use. Any unauthorized reproduction or commercial exploitation is strictly prohibited.
7. DATA PROTECTION AND PRIVACY
Your use of the Services is subject to our Privacy Policy. We process your data in accordance with the GDPR and the Finnish Data Protection Act (Tietosuojalaki).
7.1. INTELLECTUAL ANALYSIS (NON-AUTOMATED)
• Nature of Processing: We perform manual analysis of the specific text inputs or data you provide. This involves evaluating your inputs against internal philosophical and analytical frameworks to provide personalized insights.
• No Legal or Significant Effects: In accordance with Article 22 of the GDPR, we declare that these Documents are intended for informational purposes only and do not produce legal effects or significantly affect the user's legal or financial status.
Consent: By providing your explicit consent through the checkbox on our Site and submitting your data, you acknowledge and agree to this processing for the purpose of receiving the Service.
8. DIGITAL SERVICES ACT (DSA) COMPLIANCE
In compliance with the EU Digital Services Act:
• Point of Contact: For any inquiries from EU authorities or users, please contact us at tashcolour1@gmail.com. Communications with our point of contact can be conducted in English, Finnish, and Russian.
• Content Policy: We reserve the right to refuse the creation of a Document if the input data provided is illegal, contains hate speech, or violates third-party rights.
9. LIMITATION OF LIABILITY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:
• Tashcolour Tmi shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Services.
• Our total liability for any claim shall not exceed the amount paid by you for the specific Service in question.
• We do not guarantee that the Services will be error-free or that the Document prepared through manual intellectual analysis will meet your specific expectations or requirements.
• Service Availability and Force Majeure: The Services are provided on an "as is" and "as available" basis. We are not liable for any delay or failure to provide the Services resulting from causes beyond our reasonable control, including but not limited to: technical failures of third-party infrastructure (e.g., Tally, Stripe, hosting providers), internet outages, or other "force majeure" events. We do not guarantee 100% uninterrupted access to the Site.
10. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of Finland.
• Consumer Disputes: Consumers residing in the EU may submit disputes to the Finnish Consumer Disputes Board (Kuluttajariitalautakunta) or use the EU Online Dispute Resolution platform at http://ec.europa.eu/consumers/odr/.
• Jurisdiction: Any legal action or proceeding shall be brought exclusively in the District Court of Päijät-Häme (Päijät-Hämeen käräjäoikeus), Finland.
11. TERMINATION AND ACCESS RESTRICTION
We reserve the right to terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation: (a) breach of these Terms; (b) engagement in fraudulent or illegal activities; (c) providing false or misleading input data; or (d) exhibiting abusive, harassing, or "toxic" behavior toward the Company. In the event of such termination, no refunds shall be issued.
